License

By using any of the images from Sunflower Images in any way whatsoever, you agree to abide by the licensing conditions and any associated warranties.

There are three basic components to the license agreement: comping use, end product use and warranties.

Comping use

Comping of the small (150k) images available to registered clients of Sunflower Images may be carried out without charge.

Manipulation and end use

Any manipulation (such as cutting, cropping, scaling, colour changes etc) or use in any end product, whether in a commercial or non commercial environment, implies purchase of the image from Sunflower Images and the duty of payment under the terms of payment unless any other right or restriction is detailed below.

Right to use through the purchase of the image grants a non-exclusive, non-assignable right to the purchaser to use the image, subject to acknowledgement of Sunflower Images as supplier of the image, to illustrate material that may be printed and published in unlimited numbers and without payment of further royalties. The images may be manipulated, and used in printed, electronic, multimedia, video, film, TV and other publishing media.

Use of any image supplied by Sunflower Images in a pornographic, defamatory or any other offensively negative or unlawful manner is strictly prohibited.

The passing on to third parties of any images for use in any way, including use in databases and photo archives or as a downloadable image from a web site is strictly prohibited.

Model Release.

Many of our images are documentary photos and do not have model release. Whether or not an image is model released is shown adjacent to the thumbnail copy. Sunflower Images will not be held responsible for any personal infingement through the use in any way of a non model released image.

Small watermarked images

These images are freely available for viewing and pre-selection only. They are not to be used in any other way. No right of copying, commercial or other use is implied.

Small non-watermarked images

These 150k images are available free to registered clients of Sunflower Images for comping use and PERSONAL, NON COMMERCIAL, EDUCATIONAL, purposes only. Within a commercial environment they may be freely used for COMPING AND LAYOUT purposes only. Any other use requires payment. Free images may not be used in any finished product by any commercial organisation whether for internal or external use. The images may not be supplied to any third party for their use.

500k images, 5M, 10M and 24M images

Registered users may download these images for use anywhere, any time subject to full payment for each image downloaded.

Copyright and Credit

All copyright for use of the images remains with Sunflower Images and or its licensors.

For all uses of the images Sunflower Images requests a credit reading "Sunflower Images" adjacent to the published image or in an obvious credits page or screen. Where a credit is impractical, permission to leave it out should be sought prior to publication.

Warranties

Sunflower Images warrants the digital copy of the image in the form downloaded by the registered client to be free from defects in material and workmanship for 30 days from delivery. The sole and exclusive remedy for a breach of the foregoing warranty is the replacement of the digital copy of the image or refund of the purchase price, at Sunflower Images discretion. Sunflower Images makes no other warranty, expressed or implied including any implied warranty of merchantability or fitness for a particular purpose.

General

All rights to the images are owned by Sunflower Images and/or its licensors and are protected by international treaty conditions and other laws applicable to copyright.

Any registration with Sunflower Images and subsequent use of images by an individual on behalf of an organisation implies acceptance by the organisation of all terms and conditions set out in this License.

Payment

No credit card information is sent to or held on our site.

If you do not wish to purchase using your credit card online we will consider an application for a monthly credit account. We ask for business referees names and addresses with whom you have existing credit and whom we can contact to obtain a reference. To be considered for a monthly credit account, fill out the credit application form. Please note that approval may take some days, dependent upon us receiving satisfactory credit references from your referees. No purchases can be made on such an account until approved by us.
